Mortgagees that agree to modify a mortgage through the Ezequiel Santiago Foreclosure Mediation Program must deliver the modification to the mortgagor for execution at least 15 business days before the first payment due date.

Failure to timely deliver a modification gives courts grounds to order the mortgagee to reissue the modification and issue other appropriate relief in pending foreclosure actions after notice and hearing.

Failure to reissue or correct a modification constitutes both a defense to foreclosure actions and an unfair trade practice under chapter 735a.

Mortgagors' financial information and documents submitted to mediators, whether oral or written, are protected from disclosure by the Judicial Branch.

The act takes effect October 1, 2023 and amends section 49-31o of the Connecticut General Statutes.
