Commissioner of Social Services, in consultation with the Commissioner of Developmental Services, must amend Medicaid waiver programs within 30 days of enactment to authorize compensation for family caregivers providing personal care assistance services.

Compensation authorization applies to family caregivers who are legally responsible relatives, defined as spouses, parents, or legal guardians of Medicaid waiver program participants.

Applies to the three Medicaid waiver programs established under section 1915(c) of the Social Security Act that provide home and community-based services to clients of the Department of Developmental Services.

Compensation authorization is limited to the extent permissible under federal law.

Takes effect immediately upon passage.
