Nonprofit private provider organizations contracting with state agencies for health and human services may retain excess funds from contracted costs at the end of each contract term, provided they meet contractual obligations.

State agencies cannot attempt to recover or offset retained excess funds through recoupment efforts, reduced future contract amounts, or demands for reimbursement of state funds.

Nonprofit organizations cannot retain excess funds from contracts funded wholly or partially with federal funds if doing so would jeopardize federal funding or reimbursement for the contract.

State agencies must ensure payment for health and human services within thirty days after service delivery and must identify and eliminate administrative burdens on provider organizations, except when necessary to prevent fraud or required by federal law.

The Commissioner of Developmental Services may extend these provisions to other providers contracting with the Department of Developmental Services who meet their contractual obligations.
