Off-site hospital-based facilities must submit claims for reimbursement using their own separate national provider identifier and federal tax identification number, distinct from the main hospital campus identifiers, effective January 1, 2024.

Off-site hospital-based facilities are prohibited from charging facility fees unless mutually agreed upon in a contract between the health carrier and hospital, effective January 1, 2024.

Health carriers are not required to reimburse claims from off-site hospital-based facilities unless the claims are submitted in compliance with the separate identifier requirements.

Off-site hospital-based facilities that fail to submit claims properly cannot hold covered persons liable for payment of those claims.

The Insurance Commissioner is authorized to adopt regulations to implement these provisions.
