HB 6657 - Nonconsensual Towing

• Commissioner of Motor Vehicles shall establish and publish uniform rates and charges for nonconsensual towing, transportation, and storage of motor vehicles, which shall be just and reasonable, with rates reconsidered upon petition no more frequently than once every two years.

• Wrecker owners must maintain detailed records including vehicle registration, tow dates/times, locations, mileage, charges, customer information, written authorization, and photographs showing vehicle condition prior to towing, retained for two years and available for inspection.

• Property owners must install conspicuous signage at entryways stating towing policies and provide written notice affixed to vehicles at least 24 hours before removal from residential complexes, with exceptions for specific violations including disabled parking spaces, emergency vehicle areas, fire hydrants, and vehicles parked 48+ hours.

• Towing operators must notify local police within two hours of towing unauthorized or repossessed vehicles and cannot charge storage fees before police notification; wheel-locking device removal fees are capped at $50 with 10% remitted to police.

• Property owners and towing operators must obtain written authorization from the property owner or lessee within 24 hours preceding the tow, specifying the vehicle details, authorizer information, reason for removal, and time vehicle was first observed parked; vehicle owners may request immediate release if vehicle is connected but not yet removed.
