HB 06872 Summary

• Presidential electors who fail to vote for the candidates they ran under or were pledged to support shall have their votes nullified, forfeit their office, and be replaced by other electors; violators face up to one year imprisonment and/or a $1,000 fine.

• Any state resident may bring mandamus actions in the Supreme Court to compel election officials (Treasurer, Secretary of State, Comptroller, Governor) to perform their duties related to counting votes and certifying election results for presidential electors, senators, representatives, and state officials.

• Prevailing residents in mandamus actions are entitled to recover court costs and reasonable attorney's fees.

• Election-related mandamus actions are to be taken directly to the Supreme Court without intermediate appeal.

• All provisions take effect October 1, 2023.
