Public Act No. 23-188 Summary

• Implementation team shall develop a plan for prearrest diversion of low-risk children by January 1, 2024, including automatic diversion for first or second offenses, and submit findings to the Juvenile Justice Policy and Oversight Committee by July 1, 2024.

• Establishes the Juvenile Justice Policy and Oversight Committee with broad membership including legislators, commissioners, judges, child advocates, parents, young adults with lived experience, and tribal representatives to evaluate juvenile justice policies and expansion of jurisdiction to ages 16-17.

• Court Support Services Division, Commissioners of Children and Families, Education and Correction shall develop a reentry success plan by November 1, 2023, incorporating restorative justice principles, academic support, workforce connections, trauma-informed services, and reentry coordinators.

• Judicial Branch shall develop implementation plans to house all persons under 18 arrested and detained prior to sentencing in Judicial Branch custody, with updated plan including phased-in transition timeline due by December 15, 2023.

• Committee shall establish education subcommittee to develop comprehensive plan for vocational and academic education services for youth in justice system custody and transitional support services upon reentry to communities.
