Persons holding or who held elective or appointive state or municipal office, or served as sworn municipal police officers, who engaged in insurrection or rebellion against the United States or gave aid to U.S. enemies become permanently ineligible to hold state or municipal office or serve in state armed forces.

Any state resident may file a declaratory judgment action in Superior Court to determine whether a person meets the permanent ineligibility criteria, and certified copies of court declarations must be filed with the Secretary of the State.

Persons convicted of seditious conspiracy, insurrection or rebellion against the United States, or a felony related to such acts become permanently ineligible for employment by the state or any municipality upon conviction.

The act takes effect upon passage and creates a new section of law.
