Effective January 1, 2024, the Commissioner of Social Services must increase the fee schedule for complex care nursing services so that reimbursement rates for patients over age eighteen equal the rates for patients age eighteen and under, eliminating age-based fee differentials.

Complex care nursing services are defined as intensive, specialized nursing services provided to patients with complex care needs who require skilled nursing care at home.

The Commissioner of Social Services shall adopt regulations to implement these provisions and may implement interim policies and procedures while regulations are being adopted, with notice posted on the eRegulations System within twenty days and valid for no longer than nine months.

Home health care agencies and home health aide agencies may request a hearing within ten days if they are aggrieved by a rate determination due to a material change in circumstances.

The Commissioner may increase fees for agencies demonstrating extraordinary costs related to serving persons with AIDS, high-risk maternal and child health care, escort services, or extended hour services, provided no rate exceeds charges to the general public for similar services.
