Effective October 1, 2023, Probate Court employees shall be deemed state employees for purposes of collective bargaining under chapter 68, with the right to bargain collectively unless they choose to remain at-will employees.

Regional Children's Probate Court employees shall be entitled to benefits of Probate Court employees and shall not be deemed state employees except for purposes of chapter 68.

Probate Courts are added to the definition of "employer" under the state's collective bargaining law (chapter 5-270) and shall be represented in negotiations by the Probate Court Administrator or designated representative.

Probate Court employees may form not more than two separate bargaining units: one nonprofessional and one professional.

Regional Children's Probate Court administrative judges may employ persons as needed for efficient court operation with authorization from the Probate Court Budget Committee.
