Public Act No. 23-9: Racial Profiling Prohibition Act

• Establishes the "Alvin W. Penn Racial Profiling Prohibition Act" prohibiting state police, municipal police departments, and other law enforcement agencies from detaining or treating individuals differently based on perceived racial or ethnic status, except when combined with other identifying information to apprehend a specific suspect.

• Requires all municipal police departments, the Department of Emergency Services and Public Protection, and other departments with traffic stop authority to adopt written policies prohibiting stops motivated by race, color, ethnicity, age, gender, or sexual orientation, except when used in combination with other suspect description information.

• Mandates development of a standardized method by July 1, 2013 for recording traffic stop data including date, time, location, officer identification, driver demographics, violation type, and stop disposition, with notice to stopped individuals about filing discrimination complaints.

• Requires municipal and state police departments to submit monthly reports to the Office of Policy and Management beginning October 1, 2013, with electronic submission required by January 1, 2015, and allows withholding of state funds for non-compliance.

• Directs the Office of Policy and Management to annually review traffic stop prevalence and complaint dispositions by July 1, 2014, and thereafter, publishing results on its public website.
