Commissioner of Social Services shall provide medical assistance for bariatric surgery and related medical services for Medicaid and HUSKY B beneficiaries with severe obesity, effective July 1, 2023.

Severe obesity is defined as a body mass index greater than 40, or 35 or more if the individual has been diagnosed with a comorbid condition such as cardiopulmonary disease, diabetes, hypertension, or sleep apnea.

Medical services covered include FDA-approved prescription drugs for obesity treatment on an outpatient basis and nutritional counseling provided by a certified registered dietitian-nutritionist.

Medical services (excluding surgery) are provided to Medicaid and HUSKY B beneficiaries with a body mass index greater than 35, provided they meet Centers for Medicare and Medicaid Services conditions.

Commissioner may amend the Medicaid state plan and Children's Health Insurance Program state plan as necessary to implement the provisions of this section.
