Children in superior court proceedings under section 46b-129 shall be represented by counsel knowledgeable about representing children, assigned by the Office of Chief Public Defender or appointed by the court if immediate need exists.

Counsel assignment or appointment continues for the duration of the entire proceeding and the court must give parties prior notice of such assignment or appointment.

When a child's parent or guardian is accused by a competent witness of abuse or neglect, assigned counsel receives immediate access to Department of Social Services records, medical, mental health, substance abuse treatment, law enforcement, and educational records without requiring additional releases.

Assigned counsel has the right to privately consult with the child and shall act solely as the child's attorney, not on behalf of any other party.

The act takes effect October 1, 2023, and amends Connecticut General Statutes section 46b-129a(2)(A).
