Effective July 1, 2024, nursing homes must provide at least 3.6 hours of direct care per resident per day, broken down as: 0.66 hours from registered nurses, 0.49 hours from licensed practical nurses, and 2.45 hours from certified nurse's assistants

By January 1, 2026, minimum staffing increases to 4.1 hours of direct care per resident per day: 0.75 hours from registered nurses, 0.54 hours from licensed practical nurses, and 2.81 hours from certified nurse's assistants

Social work staffing requirement set at one full-time social worker per 60 residents, with recreational staff requirements to exceed pre-2022 levels

Substantial failure to comply with staffing requirements constitutes a class B violation, allowing the Commissioner of Public Health to take disciplinary action and issue citations to the nursing home licensee

Staffing violation citations must be prominently posted in the facility and included in the Department of Public Health's public listing
