Effective October 1, 2023, state agencies, local boards of education, and political subdivisions must give priority to contractors that enter into joint ventures with prequalified minority contractors when awarding capital projects, quasi-public agency projects, municipal public works contracts, or school building projects that receive state funds.

The Commissioner of Administrative Services may adopt regulations establishing prequalification requirements for minority contractors as an alternative to existing requirements; until adopted, all minority contractors are deemed prequalified.

Contract-awarding entities must report to the Commissioner of Administrative Services by December 31, 2024 and annually thereafter with information including project descriptions, contract amounts, contractor demographics, and other required details.

The Commissioner of Administrative Services must submit annual reports to the General Assembly joint standing committees on government administration, finance, revenue and bonding, and education beginning March 31, 2025.

Contractors awarded these contracts must make good faith efforts to contract with Black-owned, Hispanic-owned, and women-owned subcontractors in proportion to the demographic composition of all subcontractors in the state.
