Building permits for in-ground swimming pool construction or substantial alteration cannot be issued on or after July 1, 2024 unless a barrier complying with Section 305 of the International Swimming Pool and Spa Code (October 1, 2022 version) is installed or planned for installation around the pool.

Powered safety covers and retractable covers cannot be used in lieu of barriers around in-ground pools, and provisions allowing such covers as exceptions in the State Building Code are negated by this act.

In-ground pool owners not subject to permit requirements must maintain compliant barriers as of July 1, 2024, and those without compliant barriers as of that date must install one by July 1, 2025.

The State Building Inspector cannot grant variances, exemptions, or approve alternate compliance methods that would permit pool covers or alarms to satisfy barrier requirements or negatively impact safety.

The Department of Administrative Services must notify local building officials and post notice on its website regarding these requirements and any preempted State Building Code provisions.
