Expands the definition of legal consumer fireworks to include "nonexplosive and nonaerial consumer fireworks" such as flitter sparklers, ground spinners, party poppers, novelty smoke devices, snappers and novelty snakes, as defined by American Pyrotechnics Association Standard 87-1A.

Raises the minimum age for purchasing and possessing sparklers, fountains, and nonexplosive/nonaerial consumer fireworks from 16 to 18 years old, with a limit of 100 grams of pyrotechnic mixture per item.

Allows municipalities to adopt ordinances prohibiting the sale and use of nonexplosive and nonaerial consumer fireworks at places of public assembly, including public events like fairs, carnivals, craft shows, music events, and municipal or commercial property.

Increases the weight limit for fountains mounted on a common base from 200 grams to 500 grams of total pyrotechnic composition.

Becomes effective October 1, 2024, with penalties ranging from class C misdemeanor to class C felony depending on violation severity and whether injury or death occurs.
