Substitute Bill No. 5203 Summary

• Defines "offering price" as the full cash price a dealer will sell or finance a motor vehicle for, excluding only required government charges such as taxes, license, registration, and inspection costs.

• Eliminates the requirement that dealers separately state dealer conveyance fees on sales orders and invoices; removes the prior provision allowing dealers to charge these fees as negotiable add-ons.

• Requires dealers to disclose the offering price in any verbal or written communication with prospective buyers that references a specific vehicle or any monetary amount or financing terms.

• Mandates dealers complete comprehensive safety inspections on all used vehicles before retail sale, with documented defects clearly marked on purchase orders and titles; dealers cannot charge customers for these inspections or required repairs.

• Requires dealers to provide valid title documentation at the time of sale for used vehicles, and prohibits delivering used vehicles to purchasers until full payment is received or financing is approved; violations are class B misdemeanors.

• Effective October 1, 2024.
