Substitute Bill No. 5310 Summary

• Presidential electors shall meet on the first Tuesday (changed from Monday) after the second Wednesday of December to cast ballots and are bound to vote for the candidates under whose names they ran on the official ballot.

• Any presidential elector who fails to cast ballots for the pledged candidates shall have their votes nullified, forfeit their office, and become permanently ineligible to serve as a presidential elector.

• Election dispute procedures are established allowing electors, candidates, or voters to bring complaints to the Supreme Court regarding official rulings or vote count errors, with certification deadlines before the electoral college meets.

• All duties of the Treasurer, Secretary of State, and Comptroller to count votes and certify election results are designated as ministerial (non-discretionary), and any resident may bring a mandamus action to compel performance of these duties, with prevailing parties entitled to recover court costs and attorney's fees.

• These provisions cease to be effective if the National Popular Vote Interstate Compact takes effect generally and the governor notifies other states of its implementation.
