State agencies must increase rates for recurring contracts with nonprofit human services providers by the consumer price index percentage for all urban consumers in the northeast region annually on July 1st, effective upon passage.

Rate increases apply to nonprofits providing services for persons with physical disabilities, intellectual disabilities, developmental disabilities including autism spectrum disorder, and behavioral health services.

If the consumer price index decreases, state agencies cannot decrease rates for nonprofit providers.

The Commissioner of Social Services shall adjust Medicaid rates for nonprofit human services providers by the same percentage increase as state agency contracts, unless prohibited by federal Medicaid law.

The Secretary of the Office of Policy and Management must file a report by January 1, 2025, and every three years thereafter detailing state agency contracts with nonprofits and any appropriations needed to fund inflation adjustments.
