Adds "consumer fireworks" and "fountains" to the list of fireworks exempted from the general prohibition on fireworks sales and use, effective October 1, 2024.

Allows persons age 16 and older to purchase and use sparklers and fountains meeting specific safety requirements (not exceeding 100 grams of pyrotechnic mixture per item, with restrictions on magnesium and chlorate/perchlorate salts).

Allows persons age 21 and older to purchase, possess, and use consumer fireworks as defined in 27 CFR 555.11, and permits licensed sellers to sell consumer fireworks.

Establishes a state licensing system for consumer fireworks sellers requiring a valid federal license, a permanent retail structure complying with building and fire codes, and a clean record on fireworks violations within the preceding two years; licenses cost $1,500 annually.

Creates penalties for violations ranging from class C misdemeanor to class C felony (if death or injury results), with enhanced penalties for trafficking in fireworks valued over $10,000.
