SB 200 Summary

• Establishes a task force to study allowing social equity cannabis applicants to enter business agreements with hemp cultivators outside disproportionately impacted areas and explore other market-entry arrangements; task force must report findings by January 1, 2025.

• Requires businesses (except dispensaries, hybrid retailers, and package stores) to inventory infused beverages and legacy infused beverages by May 14, 2024, and submit reports with $1 per container fees to the Department of Consumer Protection by June 15, 2024.

• Prohibits non-authorized businesses from selling infused beverages or legacy infused beverages at retail beginning July 1, 2024; allows existing dispensaries and retailers to obtain waivers to sell legacy infused beverages through September 30, 2024.

• Creates a registration system for moderate-THC hemp product vendors effective January 1, 2025, requiring applicants to pay $2,000 application fees ($1,000 if holding a manufacturer license) and demonstrate that 85% of revenue derives from moderate-THC hemp product sales, with exemptions for manufacturers.

• Establishes sales restrictions on moderate-THC hemp products including age verification (21+), prohibition on packaging more than two containers for ingestion products, prominent youth warning symbols, and prohibits gifting products as part of commercial transactions.
