Public Act No. 24-101 Summary

• Prohibits real estate listing providers from entering into "unfair real estate listing agreements" for Connecticut residential properties (1-4 family homes) effective July 1, 2024, and declares such agreements unenforceable.

• Defines unfair agreements as those requiring no performance within one year AND either running with the land, allowing assignment without owner consent, or creating liens on the property.

• Requires providers who entered agreements before July 1, 2024 to rerecord them and file notices with town clerks by July 31, 2024, or face voidability; agreements not properly recorded are void and unenforceable.

• Allows property owners or the Attorney General to petition Superior Court to declare recorded unfair agreements void and unenforceable, with recoverable actual damages, costs, and attorney's fees against violating providers.

• Requires notification to property owners, town clerks, and the Attorney General within 30 days when listing rights are assigned under such agreements.
