Department of Public Health shall establish minimum staffing requirements for nursing homes of three hours of direct care per resident per day by October 1, 2024, composed of 0.55 hours by registered nurse, 0.29 hours by licensed practical nurse, and 2.16 hours by nurse's aide.

Direct care provided by nursing home directors of nurses, assistant directors of nurses, and staff members who have not completed orientation or training shall not count toward minimum staffing requirements.

Department of Public Health shall modify social work staffing requirements to provide one full-time social worker per sixty residents (varying proportionally by facility size) and increase recreational staff requirements as deemed appropriate by the Commissioner.

Commissioner shall adopt regulations to implement staffing requirements and may implement temporary policies and procedures while regulations are being adopted, with notice published on eRegulations System within twenty days of implementation.

Definition of "direct care" includes hands-on assistance with feeding, bathing, toileting, dressing, medication administration, and socialization but excludes food preparation, housekeeping, laundry, maintenance, and administrative tasks.
