Bill Summary: SB 310

• Family caregiver payment rates in Department of Social Services programs shall equal nonfamily professional caregiver rates for the same services, to the extent permitted by federal law.

• The Commissioner of Social Services shall use fair market value of services when determining whether asset transfers to family caregivers under legally enforceable compensation agreements violate federal asset transfer laws.

• Medical assistance for Medicaid-eligible home care services shall be provided retroactively up to three months before application date, provided the individual was otherwise eligible during that period (effective July 1, 2024).

• Individuals who discover assets after applying for medical assistance shall not be deemed ineligible if they report the discovery within 10 days, take steps to liquidate and spend down the assets, and receive DSS assistance if unable to access the assets.

• All provisions become effective July 1, 2024.
