Creates new offense of operating a motor vehicle while ability impaired for drivers with blood alcohol content of 0.05% to 0.08%, effective October 1, 2024.

Imposes immediate 24-hour license revocation/suspension upon citation, with fines of $100-$200 for first violation and $300-$500 for subsequent violations, plus 45-day license suspension after notice and hearing.

Requires violators to attend intoxicated operator's retraining program within 60 days, with fee not exceeding $85; program may be offered in-person, through distance learning, or combination thereof.

Establishes certification and oversight system for retraining program providers, including $350 application fee, $50,000 surety bond requirement, and 2-year certification validity period.

Prohibits reducing DUI charges to ability impaired offense and requires annual reports to legislature beginning January 1, 2025 on drug recognition expert training and methods to detect cannabis-impaired driving.
