Municipalities with populations of 25,000 or more must allow as-of-right installation of temporary shelter units on religious organization property for homeless individuals and refugees, effective October 1, 2025

Municipalities may impose restrictions including: maximum 8 units per lot, 400 square feet maximum size, 12-month occupancy limit per individual, 1,000-foot setback from schools and cemeteries, and requirements for toilets/showers (1 per 8 occupants per gender)

Zoning decisions must be rendered within 65 days of application; municipalities cannot require new utility connections or charge connection fees for these units, and cannot condition approval on correcting nonconforming uses

Municipalities must adopt compliant zoning regulations by July 1, 2026, or existing noncompliant regulations become void; no additional standards beyond those specified may be imposed

State Building Inspector and Fire Marshal must update the State Building Code and Fire Safety Code to regulate temporary shelter units consistent with safe occupancy, heating/cooking equipment, and 2021 International Residential Code tiny house requirements
