Contracts between the state and operators of residential facilities for the Department of Correction, Department of Mental Health and Addiction Services, or Board of Pardons and Paroles must require all resident discharges follow the individual's official discharge plan

Residents cannot be discharged due to facility closure unless transferred to an equivalent facility approved by the relevant Commissioner or Board chairperson

Closing facilities must remain operational until all residents are discharged according to their discharge plans if no equivalent facility is available for transfer

Facility operators are financially responsible for all costs incurred to comply with closure and discharge requirements

Effective upon passage and applies to contracts entered into on or after the effective date
