Local and regional boards of education must adopt three policies for school libraries: collection development and maintenance, library display and program, and library material review and reconsideration, with mandatory review every five years

Only parents, guardians, and currently enrolled students may file formal reconsideration requests to challenge library materials; challengers must provide their full legal name, address, and specific objections to identified portions of the material

Challenged materials must remain available for checkout until a review committee issues a final written decision within 60 school days; the committee includes administrators, teachers, parents, and a certified school librarian

Materials cannot be removed based solely on origin, background, viewpoints of the content or creator, or because someone finds the book offensive; once reviewed, materials cannot be challenged again for three years

Public libraries face similar requirements, with state grant eligibility tied to maintaining and adhering to these three policies; library staff who implement policies in good faith receive civil and criminal immunity
