Zoning commissions may exempt single-family residential structures from coastal site plan review requirements, effective October 1, 2026

Exemption does not apply to structures located on islands not connected to the mainland by road, bridge, or causeway

Exemption does not apply to structures in or within 100 feet of tidal wetlands, coastal bluffs and escarpments, or beaches and dunes

Zoning commissions adopting this exemption must submit quarterly reports to the Commissioner of Energy and Environmental Protection detailing approved single-family residential structures

Shoreline flood and erosion control structures remain subject to coastal site plan review requirements regardless of this exemption
