Municipal planning, zoning, or combined commissions may adopt regulations allowing developers to pay a fee instead of constructing required public sidewalks, but only when the commission finds sidewalk construction is unnecessary or impractical for the development

Fee amounts must be determined by a formula or schedule established in municipal regulations, and require consent of both the applicant and the commission before being imposed

Municipalities may limit the geographic areas where fee-in-lieu options are available

All collected fees must be deposited in a dedicated municipal fund used solely for public sidewalk construction or maintenance, separate from the general fund and not available for operating expenses
