HB 100 Summary

• Requires all contractors, subcontractors, and their employees accessing public school premises to undergo criminal history background checks and child protection registry checks before engagement.

• Criminal history background checks must be no more than 2 years old at time of service engagement, with contractors or subcontractors bearing the cost of checks.

• Prohibits access to public school premises for individuals convicted in the last 5 years of crimes listed in § 4201(c), those on Child Protection Registry Level III or IV, or those ever convicted of felony sexual crimes against children.

• Allows unvetted contractors to access school premises only when accompanied at all times by a public school staff member or designated agent, with exceptions for disaster or emergency situations.

• Department of Education must develop a standardized identification badge process for contractors and employees who successfully pass required background checks; effective January 30 following enactment and applies only to contracts entered after the effective date.
