HB 101 Summary

• Amends Title 17 of the Delaware Code to regulate traffic impact studies required by the Department of Transportation for development projects.

• Prohibits agreements between DelDOT and local jurisdictions from limiting traffic studies to restricted geographic areas; instead requires studies to cover the full estimated zone of impact on local, arterial, and regional roads.

• Requires traffic impact studies to evaluate safety impacts on vehicles and pedestrians, level of service on affected roads and intersections, and future Department expenditures, with safety factors receiving significant weight in approval decisions.

• Mandates that all traffic studies be conducted on days when schools are in session within the study district; studies violating this requirement cannot be accepted or funded with public money.

• Requires all existing Memoranda of Understanding between DelDOT and local jurisdictions to be rewritten within 180 days of enactment to reflect the new procedures, effective for rezoning and development applications filed after the Act's enactment.
