HB 190 Summary

• Authorizes and requires the Department of Services for Children, Youth and Their Families to conduct drug testing of employees and job applicants

• Requires pre-employment drug screening before any person is hired or employed by the Department

• Establishes random drug testing for all Department employees and reasonable suspicion testing when supervisory personnel suspect impairment

• Tests for marijuana/cannabis, cocaine, opiates, phencyclidine (PCP), amphetamines, and other controlled prescription drugs specified by Department regulation

• Permits Department to impose sanctions including Employee Assistance Program referral, suspension, or termination for refusal to submit to testing or positive results, but exempts lawfully prescribed drugs
