HB 201 Summary

• Amends Title 29 of the Delaware Code to rename the "Regulatory Flexibility Act" to the "Regulatory Flexibility and Oversight Act"

• Requires state agencies proposing rules or regulations enforceable by civil penalties, criminal penalties, or sanctions to prepare and publish a regulatory impact statement

• Regulatory impact statements must include statutory basis, purpose, compliance methods, affected persons, compliance costs, enforcement mechanisms, and public benefits

• Failure to prepare required regulatory impact statements renders rule adoption or amendment null and void and subject to judicial review

• Exempts emergency rules, procedural rules, non-substantive technical corrections, and amendments making rules consistent with changes in law from impact statement requirements

• Requires agencies to provide regulatory impact statements to relevant General Assembly committees for legislative oversight
