Requires all Information Technology (IT) employees and independent contractors designated by the Director of the Office of Management and Budget to undergo fingerprint-based Delaware criminal history background checks and federal FBI background checks prior to hire

Applies requirement to existing IT employees as of the effective date of the section

Disqualifies applicants convicted of felonies or Class A misdemeanors within the last 5 years, or convicted of crimes including sexual abuse, assault, robbery, and related offenses enumerated in Delaware Code sections 871-878, 854, 913, 913A, and 932-938

Permits conditional hiring when exigent circumstances require filling a position immediately, with final employment contingent on receipt of background check results

The State bears costs for employee background checks while independent contractors pay their own costs, with the Office of Management and Budget and Department of Technology and Information to promulgate implementing regulations
