Creates the Delaware Health Care Freedom Act, establishing that Delaware residents have the right to choose or decline any mode of securing health care services without penalty or threat of penalty.

Defines "health care services" as any service or treatment for physical or mental health, and "penalty" as any civil or criminal fine, tax, wage withholding, surcharge, or other consequence imposed by government to punish or discourage healthcare choices.

Prohibits public officials and employees of Delaware or its political subdivisions from imposing, collecting, enforcing, or effectuating any penalty that violates the stated public policy.

Expands the authority of the Delaware Attorney General to seek injunctive relief and defend the state, its officials, employees, and agents if any law or regulation violates the Delaware Health Care Freedom Act.

Affirms that only the State of Delaware has legal authority to regulate private health care insurance, systems, plans, and services within its borders.
