Strikes § 1500(8) of Title 26 of the Delaware Code to remove language that unintentionally mandates decoupled rate design mechanisms.

Clarifies that decoupling proposals should be subject to Public Service Commission (PSC) regulatory approval after public hearings and stakeholder input, not legislative mandate.

Restores PSC regulatory authority over rate design mechanisms that may have been inadvertently restricted by Senate Amendment No. 2 to Senate Bill No. 106.

Allows the PSC to reject decoupled rate designs if determined not to be in the best interest of ratepayers, rather than requiring implementation by statute.
