Adds new Section 1128 to Delaware Code prohibiting registered sexual offenders from residing in or loitering within 500 feet of child care facilities.

Makes it a Class G felony for a sexual offender to reside in a child care facility.

Makes it a Class F felony for a sexual offender to loiter on or within 500 feet of a child care facility property.

Defines "loiter" as idly standing, sitting, or remaining near a child care facility without legitimate reason or custody responsibility, or for purposes of soliciting sexual contact.

Establishes that "sexual offender" includes persons convicted of enumerated sexual offenses against children under 16, discharged/paroled from confinement for such offenses, or adjudged guilty but mentally ill or not guilty by reason of insanity for such offenses.
