Amends Title 7 of Delaware Code to restrict stormwater utility fees to properties that discharge stormwater directly into systems constructed, maintained, or operated by the entity imposing the fee.

Exempts non-land disturbing activities and maintenance of existing conditions from stormwater fees unless property discharges into a stormwater conveyance system owned/operated by the fee-charging entity.

Requires fees to be rescinded if they are imposed on property owners whose lands do not discharge stormwater into a system constructed, maintained, or operated by the entity imposing the fees.

Establishes that stormwater regulation lies exclusively with the State and prohibits municipalities from imposing stormwater fees through local utility ordinances except in accordance with Chapter 40 of Title 7.

Declares any local utility ordinance imposing stormwater fees in violation of these provisions void and unenforceable.
