• Amends Delaware Code Title 9 §302 to prohibit county governments from requiring elected or appointed officials to forfeit their vested pension benefits from prior county employment.

• Former county employees who are elected or appointed to county office may continue to receive their previously earned vested pension benefits without penalty.

• Former employees who choose to receive their vested pension benefits are ineligible for additional years of service credit or new vested pension benefits during their term in elected or appointed office.

• Former employees may alternatively choose to forego receiving retirement benefits during their term in office, which would allow them to earn additional service credits and pension benefits.
