Establishes the Delaware Health Care Freedom Act as Chapter 99A of Title 16, declaring that Delaware residents have the right to choose or decline any mode of securing health care services without penalty.

Defines key terms including "health care services," "mode of securing" (purchasing directly, through insurance, or employer/government benefits), and "penalty" (civil/criminal fines, taxes, fees, or other consequences imposed by government).

Prohibits state officials, employees, and agents from imposing, collecting, enforcing, or effectuating any penalty that violates the public policy of health care choice freedom.

Expands the Attorney General's duties under Title 29 §2504(10) to seek injunctive relief to preserve residents' health care rights and defend the state against any law or regulation—including federal law—that violates the Delaware Health Care Freedom Act.

Affirms that Delaware has exclusive legal authority to regulate private health care insurance, systems, plans, and services within its borders, while preserving existing government health care programs in which participation is voluntary.
