HB 90 Summary

• Eliminates automatic 2-month contract extensions for Department of Education employees notified of contract nonrenewal, reducing total notice period from 6 months to 4 months.

• Requires employees to request a formal hearing within 15 calendar days of receiving notice of nonrenewal or dismissal to ensure timely hearing completion before contract expiration.

• Establishes that the Office of Management and Budget shall convene hearings no earlier than 10 days and no later than 90 days after a timely hearing request, unless both parties agree otherwise.

• Grants employees the right to present information in their defense and have legal counsel present at dismissal and nonrenewal hearings.

• Takes effect for employment contracts issued on or after July 1, 2011.
