HJR 3 Summary

• Establishes a Communications Tax Review Group to study Delaware's tax laws applicable to communications providers and make recommendations for improvements.

• Review Group must report to the House of Representatives by March 14, 2012, examining Wire and Transmitter Tax, Special Betterments Property Tax, Excise Tax, and cable television franchise fees.

• Group composition includes the Chair of the House Telecommunications Committee (chair), one House Revenue and Finance member, one Senate member, Secretary of Finance, Director of Economic Development, representatives from three counties and local governments, and representatives from local exchange, cable television, and wireless carriers.

• Department of Finance directed to collect revenue information from municipalities, counties, and communications service providers for fiscal year July 1, 2010 through June 30, 2011, and provide data to Review Group by November 15, 2011.

• Individual company information from communications providers shall remain confidential; only aggregated data may be disclosed to prevent disclosure of market share and sensitive market information.
