House Resolution 33 requests the Department of Education begin developing standardized student code of conduct policies for all Delaware public school districts and charter schools.

The standardized policies should include common legal definitions of student offenses that result in alternative placement or expulsion, common due process procedures for alternative placement meetings and expulsion hearings, and common procedures for handling Attorney General reports.

The resolution implements a recommendation from the School Discipline Task Force, created by House Resolution 22 of the 145th General Assembly, which studied school discipline laws and policies.

The Department of Education must develop these policies with input from stakeholders who implement, enforce, and are affected by student codes of conduct.

The standardized policies aim to minimize inequities for students, families, and the public school system resulting from differences in discipline policies across districts.
