Senate Bill 103 Summary

• Renames the Division of Waste Management to the Division of Waste and Hazardous Substances and enumerates its programs including underground storage tanks, boiler safety, hazardous materials emergency response, and site remediation.

• Redesignates the Division of Boiler Safety as a Program within the Division of Waste and Hazardous Substances and eliminates the position of Director of Boiler Safety.

• Moves boiler safety enabling legislation from Chapter 80 of Title 29 to new Chapter 74B of Title 7, establishing the Boiler Safety Program with authority over fabrication, construction, installation, operation, inspection and repair standards.

• Creates a Council on Boiler Safety composed of 5 members appointed by the Governor for 3-year terms, including representatives from insurance, manufacturing, boiler users, mechanical engineering, and licensed stationary engineering.

• Authorizes fees from the Aboveground Storage Tank Program to fund administration costs of the Underground Storage Tank Program and the Boiler Safety Program.
