SB119 Summary

• Amends Chapter 73 of Title 15, Delaware Code to establish procedures for special elections to fill vacancies in the U.S. House of Representatives from Delaware.

• Governor must appoint the election date and may choose to hold it before or on the date of the next general election; writs of election must be delivered to county election departments at least 60 days before the election.

• Political parties with at least 1/10th of 1 percent of registered voters in the state as of the last day of the month before the writ is issued may nominate a candidate; nominees must submit certificates by 7 days after writ issuance.

• State Election Commissioner must publish notice of the election in newspapers within 10 days of the writ; special election shall be conducted under the same procedures as special elections for General Assembly vacancies.

• County election departments may combine election districts for efficiency, assign 2-5 voting machines per voting district, and employ sufficient election officers; Office of Management and Budget must transfer funds to cover election costs within 5 business days of writ issuance to ensure compliance with the Military and Overseas Voter Empowerment Act's 45-day ballot mailing requirement.
