SB144 - Pawnbrokers, Secondhand Dealers and Scrap Metal Processors

• Adds definition of "consumer" as any person purchasing retail products for personal use rather than resale or processing.

• Eliminates the definition of "flea market" and adds new definition of "retail" to clarify sales to final consumers versus resellers.

• Exempts secondhand dealers engaged in retail sales of goods, produce, or food products to consumers from fixed or open market locations from scrap metal processor regulations.

• Increases reporting requirements for scrap metal processors to include date/time of purchase, type and grade of metal, weight, payment amount, vehicle information, seller's name and address, and signatures of both seller and processor.

• Requires scrap metal processors to record identification information for each seller, including driver's license details or valid state-issued photo ID with physical descriptors (sex, race, distinguishing features, age, height, weight).
