DE SB201

Removes the Delaware Health Information Network (DHIN) from the organizational control of the Delaware Health Care Commission and establishes it as an independent not-for-profit, public/private corporation.

Restructures the DHIN Board from 13 members to 15 members, including 5 ex officio members from state agencies (Department of Technology and Information, Office of Management and Budget, Department of Health and Social Services, Department of Insurance, and Controller General) plus 10 members representing consumers, businesses, health insurers, hospitals, physicians, and other healthcare providers appointed by the Governor.

Grants DHIN authority to independently adopt and amend its own rules and regulations, establish fees for services, contract with third parties without state employment restrictions, establish special funds accounts, and sell or license intellectual property.

Requires DHIN to report directly to the Governor and General Assembly instead of the Health Care Commission.

Preserves all existing DHIN assets, contracts, and regulations promulgated by the Health Care Commission, which remain in effect until amended or repealed by DHIN.
