Senate Bill 230 Summary

• Requires all public employers in Delaware to register with and use a federal Status Verification System (E-Verify or equivalent) to verify employment authorization of all new employees by July 1, 2011.

• Prohibits public employers from entering into contracts with contractors or subcontractors for physical performance of services in Delaware unless they register with and participate in the Status Verification System.

• Requires state agencies and political subdivisions to verify lawful presence in the United States for applicants age 14 and older seeking state, local, or federal public benefits, with limited exceptions for emergency medical care, disaster relief, immunizations, and specified community services.

• Requires applicants to execute an affidavit under penalty of perjury stating they are either a U.S. citizen or qualified alien, with verification through the federal SAVE Program for qualified aliens.

• Mandates annual reporting by agencies to the Department of Justice on compliance, fraud, abuse, and verification errors related to public benefits administration.
